This Consumer Health Data Privacy Notice (“Notice”) supplements the information contained in the Hoyu America Company (“Hoyu,” “we” “us,” or “our”) online Privacy Policy, and applies solely to personal data defined as “consumer health data” subject to the Washington My Health My Data Act (“MHMDA”), the Nevada Health Data Privacy Act (“NHDPA”), or other applicable state consumer health privacy law.

What Does This Privacy Notice Cover?

This Notice describes the consumer health data we collect from you in the event you report an adverse reaction to one of our products. Specifically, this notice describes how we collect and use this data, to whom we disclose it and why, and the choices you may have regarding our use or disclosure of your consumer health data. This Notice only applies to consumer health data, which is a subset of personal information that identifies your past, present, or future physical or mental health status. Examples of consumer health data are provided below.

What Categories of Consumer Health Data Do We Collect?

We may collect or receive the following categories of consumer health data: • Health conditions, treatment, diseases, or diagnosis.

  • Social, psychological, behavioral, and medical interventions.
  • Health-related surgeries or procedures.
  • Bodily functions, vital signs, symptoms, or measurements of information.
  • Photographs of any adverse effects or reactions to our products.
  • Other health information you voluntarily provide to us.

What Are the Categories of Sources From Which We Collect Your Consumer Health Data?

We may obtain consumer health data from different sources, including directly from you, from our affiliates, and from other third parties at your direction or on your behalf.

What Are the Purposes for Collecting Your Consumer Health Data?

We collect and use consumer health data to respond to and process any claims of adverse reactions to our products and as reasonably necessary to provide you with the services you have requested or authorized. We may also collect and use consumer health data in order to meet our legal reporting obligations, and conduct research and development to improve our product safety. Additionally, we may use consumer health data for the purposes for which we obtain your consent, as required by law.

How Do We Share Your Consumer Health Data and Why?

We may share each of the categories of consumer health data described above to the following types of parties in order to investigate, process, report, and respond to adverse event claims regarding our products:

  • Other Hoyu Group Entities (Affiliates). We may share consumer health data with other members of the Hoyu family of brands including affiliates that are related by common ownership or control.
  • Business Service Providers. These are persons or entities with whom we have a relationship to provide business operations services and support to Hoyu. These may include customer service providers, payment processors, insurance providers, business software service providers, and other similar entities.
  • Professional Service Providers. These include lawyers, accountants, consultants, security professionals, and other similar parties when disclosure is reasonably necessary to comply with our legal and contractual obligations, or to protect the rights, property, and safety of us, our customers, and the public.
  • Law Enforcement/Government Agencies. These include persons to whom we are required by law to provide information, such as pursuant to a subpoena or court order. This may also include regulatory authorities to whom we are required to report potential adverse event claims regarding our products.
  • Corporate Transaction Disclosures. These include persons involved in the consideration, negotiation, completion of a business transaction, including the sale, merger, consolidation, acquisition, change in control, transfer of substantial assets, bankruptcy, or reorganization, and any subsequent integration.
  • Authorized Parties. We may share consumer health data with any other party where you have provided your consent for such disclosure.

How Can You Exercise Your Consumer Health Data Rights?

If you are covered by the MHMDA, the NHDPA, or other applicable consumer health privacy law, then you may have certain rights with respect to your consumer health data, including the right to (1) request access to your consumer health data; (2) confirm whether we have disclosed or sold your consumer health data; (3) delete your consumer health data; or (4) withdraw your consent or authorization relating to such data. You can make these requests by contacting us as described below. You have the right to appeal our decision with respect to a request you have submitted by contacting us as described below.

Updates to This Privacy Policy

We reserve the right to modify this Notice at any time to reflect changes in our practices, services, or legal obligations. Any modifications will be effective upon the date specified in the updated Notice. If we make material changes to this Notice that significantly affect your rights or the way we collect or use your consumer health data, we will notify you through the most appropriate channels. Generally, this will be done by updating the date at the top of this page. Other notification methods may include sending an email to the address you have provided, posting a notice on our websites, apps, or services, or other methods as required by law.
